Neil Getnick Testifies before NYC Council on NYC FCA

Neil Getnick, managing partner of Getnick & Getnick LLP and chairperson of Taxpayers Against Fraud, testified before the New York City Council Committee on Governmental Operations in support of the city’s efforts to extend and improve its False Claims Act and implement other protections for whistleblowers.

Mr. Getnick lauded the Council’s efforts in proposing amendments to the FCA which would allow the city to override dismissal based on the public disclosure bar and conform relator’s share percentages with that of the state and federal False Claims Acts, and in proposing other laws to protect whistleblowers from retaliation by their city-contractor employers.

Suggesting Changes to NY State’s False Claims Act

Mr. Getnick made several suggestions to the Council, including implementing a provision which would expressly permit tax cases under the city’s False Claims Act, an approach pioneered by New York State. Mr. Getnick, who played a role in passing the city’s 2005 False Claims Act and testified at an earlier January 2012 hearing on the Act, thanked the Committee for continuing the public-private partnership which makes the False Claims Act so effective.
