Managing Partner Neil V. Getnick Appears as Guest Speaker at NYU Law Business Crime Course
Managing Partner Neil V. Getnick was a guest speaker at the New York University School of Law’s Business Crime course taught by Professors Jennifer H. Arlen and Joseph P. Facciponti. Anthony Antonelli, Global Head of Litigation and Employment Law at the Royal Bank of Canada, also participated as a guest speaker.
Mr. Getnick and Mr. Antonelli answered questions from law students on the topic of compliance and the Securities and Exchange Commission’s (“SEC”) whistleblower program. Mr. Getnick spoke to students about how robust corporate compliance programs are the first line of defense against corporate fraud, as well as the role of whistleblower laws when compliance programs fail.
Mr. Getnick has long advocated for corporate compliance programs that are motivated by business-driven integrity rather than check-the-box, law-driven compliance. A business-driven integrity program is viewed throughout the company as a profit center and a competitive advantage, rather than a cost center or an obstacle. As a result, internal reports of misconduct are welcomed and vigorously investigated. When companies fail to have robust business integrity programs, employees who report wrongdoing are often ignored and penalized. That is when whistleblower laws, and government agencies such as the SEC, come into play.
