Getnick Law Attorneys Advocate for Stronger NY FCA through NYSBA

The New York State Bar Association Commercial & Federal Litigation Section Executive Committee has approved, and NYSBA has sent the Governor’s Counsel, a comment strongly supporting New York Senate Bill 4730 / Assembly Bill 2543.  In their capacities as Co-Chairs of the Section’s Civil Prosecution Committee, Getnick & Getnick attorneys Neil Getnick, Richard Dircks, and Courtney Finerty-Stelzner were the principal authors of the comment and advocated for its approval before the Section’s Executive Committee.

The Bill would close an existing loophole in the New York False Claim Act, under which wealthy individuals and corporations that knowingly and illegally fail to file tax returns are able to evade liability, even though those who file false tax returns are liable under the law.  If enacted, the Bill will promote greater tax fairness, increase New York’s resources to address tax violations, and assist New York recover unpaid taxes.
