Partner Margaret Finerty concludes term as Liaison to American Bar Association Task Force on Independent Monitoring

Getnick Law partner Margaret J. Finerty has concluded her work as Liaison to the ABA’s Task Force on Corporate Monitors Standards. The Task Force spent two years looking into best practices regarding how the monitor is chosen, the scope of the monitor’s work, ethical considerations of the monitor, how the monitor is paid – how much and by whom, if there are disputes how they are resolved, and oversight of the monitor. The Task Force has presented its recommendations to the ABA’s Criminal Justice Section Standards Committee and they have been accepted with minor revisions. The Criminal Justice Section Council will consider the final standards regarding corporate monitors before the end of the year.

Independent Monitoring And The Impact of ABA Criminal Justice Standards

For forty years, the ABA Criminal Justice Standards have guided policymakers and practitioners working in the criminal justice arena, and the Standards on Corporate Monitors will be widely influential in guiding the selection of corporate monitors under Deferred Prosecution Agreements and by regulatory agencies.
